The Washington DC Court of Appeals has issued its decision in 
Bishop Harry Jackson's appeal of the DC Board of Elections and Ethic's decision that his proposed marriage initiative--a ban on same-sex marriage--was an improper subject of an initiative. All 9 judges agreed that Jackson's proposed marriage initiative would violate the Human Rights Act and is, thus, not permitted.

And, in the absence of a successful appeal, marriage equality in Washington DC, which went into effect earlier this year, cannot be subject to an initiative.
