It wasn't much of a standoff, as standoffs go, but still............

The Today Show, which has a yearly event to feature the wedding of some lucky couple who wish to have their most prized moment immortalized by Matt Lauer, has always been gay-friendly.

Until this year.

Suddenly, same-sex couples were not allowed to enter the Wedding Lottery that is the Today Show. It seems that this year the “Modern Wedding Contest” application included only “bride” and “groom” as options for applicants to choose.

Huh? Bride and Groom.

Oh no honey. It should also be groom and groom, and bride and bride.

So, GLAAD got on the stick and organized a mini-revolution with petitions demanding that Today open the contest to all couple. NBC argued that it was excluding same-sex couples because “the couple must be able to be legally married in New York, which is where the wedding will take place.”

Yeah, but, um, NBC? You have a whole news division at your disposal, so you might have checked that, while marriage equality is not the law of the land in New York, same-sex weddings are legal. And, since same-sex couples can obtain licenses in Iowa, Connecticut, Massachusetts, Vermont, New Hampshire and Washington DC, they then can be married in New York, and their marriage recognized int he state that issued the license.

Got that, NBC? Stop focusing on the license and focus on the wedding.

Following a meeting between GLAAD and NBC executives, NBC announced that after listening to community concerns, i.e. a bunch of pissed of LGBT's with email access, it will open the contest to same-sex couples and extend the submission deadline until Monday, July 12. Finalists will be announced later this year and the wedding takes place live on the Today Show this October.

So, c'mon you gay folks looking for your fifteen minutes of fame, get busy and enter. Wouldn't it be a great thing if a gay couple won? Wouldn't it be amazing to have a gay wedding broadcast nationwide?

Deputy President of the Supreme Court, David Hope, on the Supreme Court of Britain ruling that LGBT people living in parts of the world which aren't so open-minded can find refuge in the UK:
“To compel a homosexual person to pretend that his sexuality does not exist or to suppress the behaviour by which it manifests itself is to deny him his fundamental right to be who he is. Homosexuals are as much entitled to freedom of association with others who are of the same sexual orientation as people who are straight.”
Sad to say, there are many LGBT around the world, and in this country, who are need of a safe place to live.

Joan Rivers, on the one scene she asked to have cut from Joan Rivers: A Piece Of Work:
“I gave them carte blanche. There was only one scene in the film that I had them remove and it involved Edgar. Melissa asked that it be taken out. There was a scene where I walk by Edgar’s photograph, and I say ‘Fuck you’ for what he did. Unless you’ve lived through a suicide, you don’t know what it’s like. Suicide is a very selfish thing to do, and leaves the "survivors" feeling angry at the ones who killed themselves.

He's not saying anything because he wants to be the one to say it.

Maybe then he'll understand that, while one's own sexuality is one's own business, it's important to come out, so that you can truly feel free, and trul be yourself.

Federal Court Rules DOMA To Be Unconstitutional


This is big. And could very well get bigger.

US District Court Judge Joseph Tauro ruled yesterday in Gill v. Office of Personnel Management that Section 3 of the Defense of Marriage Act [DOMA] violates the equal protection of the laws guaranteed by the Due Process Clause of the Fifth Amendment of the Constitution.

The Gill case does not seek to outright challenge the right of same-sex couples to marry, but it addresses the discrimination faced by same-sex couples who were legally married in Massachusetts and are subsequently treated differently by the federal government than opposite-sex married couples.

Section 3 of DOMA defines "marriage" and "spouse" at the federal level as
constituting only opposite-sex couples. It reads:`In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of the various administrative bureaus and agencies of the United States, the word `marriage' means only a legal union between one man and one woman as husband and wife, and the word `spouse' refers only to a person of the opposite sex who is a husband or a wife.'.
Judge Tauro: This court need not address these arguments [about whether strict scrutiny should apply in this case], however, because DOMA fails to pass constitutional muster even under the highly deferential rational basis test. As set forth in detail below, this court is convinced that “there exists no fairly conceivable set of facts that could ground a rational relationship” between DOMA and a legitimate government objective. DOMA, therefore, violates core constitutional principles of equal protection.

Similarly, a companion decision in Massachusetts v. U.S. Dep't of Health and Human Services was also issued, with Judge Tauro finding that DOMA also violates the Tenth Amendment and the Spending Clause of the Constitution.

Judge Tauro: That DOMA plainly intrudes on a core area of state sovereignty—the ability to define the marital status of its citizens—also convinces this court that the statute violates the Tenth Amendment.

These are small but important steps on the road toward marriage equality, and equality under the law for all Americans, regardless of sexual orientation.

WalMart Spends Millions To Avoid A $7000 Fine............Seriously


Wal-Mart is for idiots. Or Wal-Mart is idiots.

Wal-Mart has spent more than a year and more than two million dollars in legal fees battling a $7,000 fine that federal safety officials assessed after shoppers trampled a Wal-Mart employee to death at a store on Long Island on the day after Thanksgiving in 2008--Black Friday.

Yeah, two million to save 7,000. That's Wal-Mart. And federal officials are stupefied as to why Wal-Mart is fighting so hard, and so expensively, against such a modest fine. I mean, they've already spent millions trying to stop this from ever happening again before the $7,000 fine was even levied.

In fact, three weeks before the federal Occupational Safety and Health Administration [OSHA] ordered the fine, Wal-Mart, hoping to avoid criminal charges, reached a settlement with the Nassau County district attorney's office that called for the company to adopt new crowd management techniques in all 92 of its New York state stores. In addition, Wal-Mart agreed to create a $400,000 fund for the customers injured in the stampede and to donate $1.5 million to various community programs in Nassau County.

But Wal-Mart is still spending millions to fight the $7,000 federal fine.
The company is arguing that the government is improperly trying to define “crowd trampling” as an occupational hazard that retailers must take action to prevent.

So, let me get this queer, Wal-Mart doesn't think stores, who capitalize on these Black Friday sales, and any number of other sales, needs to protect it's potential shoppers and employees on their property?

Okay.

In contesting the penalty--and again, it's $7,000--Wal-Mart has filed 20 motions and responses totaling some 400 pages, and has spent at least $2 million on legal fees. The dispute has become so heated--and Wal-Mart’s defense so vigorous--that OSHA officials complain that they have had to devote huge numbers of staff time to the case, including 4,725 hours of work by employees in the legal office.

It's seems like Wal-Mart is spending this two-million-plus to overwork OSHA just make the case go away, because, just in case any other Wal-Mart customers or employees are stampeded upon and injured, or killed, they shouldn't have to do what they've already done in the Nassau case.

It doesn't make sense, and if it doesn't make sense, it's just big corporate greed looking out for big corporate greed at the expense of their own customers.

But, really, do we expect anything else from Wal-Mart?

What in The Hell Is Wrong With Bobby Jindal? That's A Rhetorical Question

Louisiana Governor, Bobby Jindal, has signed into law one bill which makes it legal to carry a gun into church, and another law which makes having sex with a minor a misdemeanor, along the lines of having sex with a prostitute.
Let's start with the God Guns.
The "Gun-In-Church" bill, authored by Republican--of course--Henry Burns, allows qualified person to carry concealed weapons, if they have passed training and background checks, into churches, mosques, synagogues or other houses of worship as part of a security force. And to make the congregation feel safer about having armed nutjobs in church, the pastor or head of the religious institution must announce verbally or in weekly newsletters or bulletins that there will be individuals armed on the property as members of the security force.
Burns says he wrote the bill to protect religious institutions in crime-ridden or "declining neighborhoods."
Um, Henry? Why not just get all guns off the streets and then you won't need God Guns?
Opponents of the measure say that churches, synagogues, mosques and other houses of worship should remain free of guns and violence and should focus on worship.
Ya think?
But Bobby Jindal also signed a bill that puts the penalty for a first conviction for soliciting a crime against nature--having sex with a minor--on the same footing as soliciting for prostitution. It changes the crime from a felony to a misdemeanor, with a $500 fine, or six months in jail, or both.
However, a second offense for having sex with a minor would still be a felony punishable by up to five years in jail, a $2,000 fine, or both. If the first initial conviction is solicitation of a person under under 17, harsher penalties will apply.
So, raping a child is just like having sex with a prostitute? Unless you get caught a second time; raping one child is sorta okay, but two is just, well, sick.
God Guns and Child Rape.

Top Chef: I Cooked Up Some Thoughts

Just some random appetizers on last night's show:
Arnold got the Last Weeks Winner/This Week's Loser Edit from the moment the show started, so I wasn't surprised he was sent packing. But, after Lynne's refusal to cook the pasta until the last second--which is what ruined their dish--I was thinking, and hoping, he'd pack his knives in Lynne's neck and then go.
Tamesha getting the 10K was lovely. She's stepping out of the Middle-Of-The-Pack-So-No-Screen-Time squad. And Tiffany is, too; at least I think she is because I now remember her name.
Amanda playing the Poor-Me-And-Stephen-Nobody-Thinks-We're-Good sad song. No, honey, it isn't that they don't think you're good, it's that they don't like you.
Alex and his new role as top Chef Perv. Was I the only one who thought his comment about using his 10K if he won--which he didn't--on a whore and an eight-ball just a little off-putting? And his comment on how he doesn't so much cook for babies as try to make babies? Ick. Especially when you realize that when Alex tries to make babies he's usually alone, with soft lighting an an old stiff towel nearby. TMI.
Mike Isabella as one of the guest judges? Talk about scraping the bottom of the saute pan for the crusty bits. Misogynist fuck. And his comment that he liked the hummus inspired dish because he has hummus on his menu? Who the frick cares you asshat? I know, go figure, I still don't like Mike.
And Angelo's painted on smile when he realized maybe Kenny would go home was kind of evil and sick. His lack of using his low sexy voice this week was also sick, and evil. And it was sick how he was flirting with Tamesha. I may be getting over my Angelo.
Mainly because we had Bryan Voltaggio talking about the gnudi and all I could think of was when was he going to get gnudi? Stop snarling, you knew that was coming.
I loved Tom Colicchio's indignation at the fact that one of the cheftestants used canned beans. I was certain he was gonna leap over the table and go after them a la Joan Crawford: No canned beans EVER!!!!!!
Still, I was sad to see Arnold go. I don't get that while the judges thought his dish was fantastic, except for Lynne's undercooked pasta, that they chose Kenny and Kevin, who had no juice on their ribs--I will make no sexual joke here--and there was little to no horseradish in the tempura, which, for me, is cardinal sin one.

I sometimes don't get the judging.

Linda Lingle Is An Asshat

After weeks of lobbying and political maneuvering, sign waving, flag waving, letters and emails, Hawaii governor, Linda Lingle, vetoed a measure that would have given same-sex and unwed heterosexual couples the same protections under the law as married couples.

Linda Lingle:
"After months of listening to Hawaii's citizens express to me in writing and in person their deeply held beliefs and heartfelt reasons for supporting or opposing the civil-unions bill, I have made the decision to veto the bill. I have been open and consistent to my opposition to same-gender marriage and find that the bill is essentially marriage by another name. My personal opinion is not the basis for my decision ... Neither is my veto based on my religious beliefs ... I am vetoing this bill because I have become convinced that this issue is of such of societal importance that it deserves to be decided by all the people in Hawaii."


Yes, Linda, let's have the majority vote on the rights of the minority. But let's also ask them, if marriage is so sacred, to vote to outlaw divorce.

Of course, Lingle, having been married, and divorced, twice, might not like that idea. I always love the irony of those anti-marriage equality people who trod out the sanctity of marriage bullshit, when they have a couple of marriages under their own belts. I say we work to enact legislation telling the heteros that they are no longer allowed to divorce.

It really will be until death do they part.

Danish architectural practice, Henning Larsen Architects, has won the competition to design the Batumi Aquarium, in the Republic of Georgia, by creating a design inspired by the characteristic pebbles of the nearby Batumi beach.
The building stands out as an iconic rock formation visible from both land and sea, and is comprised of four self-supporting exhibition areas where each of the four stones represents a unique marine biotype: the Aegean and Mediterranean Seas, the Indian Ocean, the Black and Red Seas, and finally the more interactive exhibition.
Around the aquarium, a landscape of different sea archipelagos will provide opportunities for innovative outdoor research and learning as well as informal meetings along the beachfront.
Its significant expression inspired by nature will not only make Batumi Aquarium a spectacular new landmark in Georgia but also a state-of-the-art contribution to exploring life underneath the sea surface.

They Deport Americans, Don't They?

If, after reading this, you still think Jan "Eva Braun" Brewer and the Arizona Asshats are doing the right thing, there is no hope for you. You'll never understand because you're probably white, middle-class, and think you know who the right people are and who can stay in this country and who should go. Now, to be fair, this story doesn't take place in the Arizona Fascist State, but it is a direct result of the anti-immigration-as-long-as-you're-Mexican sentiment growing in the Southwest.

Down in Texas, nineteen-year-old Luis Alberto Delgado wasn't wearing a seatbelt while riding in a car, which is illegal. And that one little click could have kept him safe, in a multitude of ways. See, his brother, the driver, was stopped by police and Luis was cited for the lack of the buckle-up; the normal fine for such an offense is a fine of somewhere between $25 and $50.

But, in Luis Delgado's case, he wasn't fined; he was deported. He was sent to Mexico, unable to re-enter the United Sates. Good? you say, Them dirty Mexicans should be sent back? Well, Luis Delgado is an American citizen with a valid US birth certificate, Texas ID, and Social Security card to prove it.

Really? So how did immigration authorities determine that Delgado was not an American? It's simple; he speaks poor English. That was enough to convince the police to call U.S. Border Patrol, enough to make immigration authorities insist that he had fake papers, enough to motivate them to coerce Delgado into signing papers that he believed would allow his release, but actually led to him being immediately removed to Mexico.

Now, this American of Mexican descent could be sentenced to twenty years in jail just for trying to come home. And, as for his poor English, Luis Delgado says that he was born in Houston, but moved to Mexico and spent most of his childhood there, hence his shaky English.

But, seriously, is shaky English a strong enough reason to send someone packing? If it is, I know a helluva a lot of people, white people, here in South Carolina who should be worried. But, they aren't worried because the color of their skin is better than a birth certificate or driver's license or Social Security card. White is right, in America these days.

And yet, in the America these days, we have people like Jan Brewer who want to create a state of panic for anyone with an accent, or brown skin, or god forbid, both. People like Jan Brewer would allow Spanish-speaking members of society to be treated as second-class citizens. But the fact remains, no matter how many of you might want to change it, there is no official language of America; that's what makes it America. We are everyone and we are from everywhere; we speak every language; we worship, or don't worship, any way we choose. But we don't, or at least we shouldn't, punish anyone because they sound different or look different or act different.

That, most decidedly, is not America.

Happy [belated] Birthday Lindsay


Y'all know that Lindsay Lohan and I are BFF's, right? I mean, that is until she beat me out for the starring role in Mean Girls, and then I bested her in getting the part of Drag Queen #7 in the Smallville Follies. There was some resentment, some bitterness, and I did want to wish her a happy birthday this past week, but I didn't bother. And, now, I'm left baking a cake with a file in it.

Lindsay's going to jail.

Lindsay Lohan was sentenced to 90 days [30 days for reckless driving in which she drove into the bushes and fled the scene; 30 days for a DUI she received that night, before she was 21; and 30 days for a DUI she received two months later] followed by a 90-day in-patient rehab program for violating probation on the DUI cases.

This is the life of a twenty-four year old woman.

Lindsay spoke to the court before sentencing: "I wasn't expecting any special treatment aside from the understanding that I have to provide for myself, I have to work. My schedule is, unfortunately, very different. Having said that, I did do everything I was told to do and did the best I could to balance jobs and showing up....I'm not taking this as a joke. It's my life, it's my career....I've learned from my experiences, I take responsibility for my actions, I've tried to do the best I can."

Not so, said the judge. And, to be honest, Lindsanity may end up serving only 23 days of the 90 sentence, which leads one to ask: Why sentence someone to 90 days? Just give them the 23.

And while I have made light of Lindsay's issues with substance abuse and alcohol abuse, along with the stories of her stealing things that don't belong to her, I feel bad for the old gal.

If someone, anyone, including that Enabling-Media-Whore-Mother-Of-Hers had ever said to Lindsay, Enough! she might not be going to jail and rehab right now. But she has been coddled and babied and allowed to live her life with no consequences for far too long, and this is the result.

Enabling-Mother-Dina-Lohan, who couldn't be bothered going with her oldest daughter to court--she was probably meeting her dealer--said, as soon as the verdict was announced: "This is so not fair to do this to my child."

Hey Dina, you moron. Lindsay is no longer a child. She is a twenty-four-old woman with an addiction to drugs and alcohol. She crashed a car two months before turning 21, fled the scene, and was subsequently caught, where her Blood Alcohol Level tested at 0.16 [twice the legal limit] and she tested positive for cocaine. She also said she wasn't driving, which turned out to be a lie. Two months later she commandeered, er, stole, a car, and chased someone through the streets of LA at 80 miles an hour, and once again was stopped. She lied, again, and said she wasn't driving; she was. She said she wasn't drinking; she was. She tested positive for cocaine.

This is not a child, Dina. Get it through your fat fame-obsessed head. This is a drug addict and alcoholic who needs help, and not the kind you offer.

I'll be sending my cake to the Beverly Hills Jail.

Happy Birthday Lindsay. And instead of getting gifts from everyone else, why not give yourself a gift and get your fucking life together.

If A Tree Falls In Your Front Yard Does It Mean It's Tuesday?

Last Friday we had a guy come out and give us an estimate to cut down a dead tree in the front yard. I was afraid that with these bouts of bad weather, high winds and rain, that we'd had the past few weeks, the tree would topple onto the house. Ii had visions of homeowners insurance denying the claim because insurance companies are whores, and because, well, the tree was dead and should have been taken down years ago so it'd be out fault,


Carlos was going to call a tree-cutter referred to us by Round-The-Way-Gays, David and Neal, and as he and I walked into the front yard he said to me:


How tall is that tree? About twelve feet?
TWELVE feet? Look at me....I'm six feet tall. Is the tree twice as tall as me?
I thought it was about twelve feet.
If it was twelve feet we could cut it down ourselves.


We step onto the lawn and I point to the dead tree--played in this picture by the thick red line because the actual tree was already down when I snapped it.


It's about forty or fifty feet tall.
I didn't know.


I had a flash of Carlos cutting down the tree and taking out two of the bedrooms and a bathroom while he was at it. I'm still shuddering at the thought.


Anyway, being the holiday weekend, the tree guy decided to come out this morning to cut it down. I figured I'd have to stay home most of the day to wait for him but he and his crew arrived at 7:30 AM and began working. The tree was down, and cut into sections before 8 AM.

And, as if I needed any proof that we couldn't have done this ourselves, the tree was standing just a couple of feet from this other, much smaller, much healthier, tree, and they brought it down without harming a single leaf on this beauty!
Now, all I need is a big axe--don't worry, honey, it's for the tree--and we'll have a nice stash of firewood come winter. And we still have the two bedrooms and the bathroom in one piece!

Ryanair Wants You To Stand Up For Air Travel

I've heard of standing-room only, and I've heard of flying stand-by, but flying standing up?
English cheapie airline, Ryanair, plans to sell £5 tickets--roughly $7.50 American--for standing-room only flights.
Michael O'Leary, Ryanair's chief executive, also announced new proposals that will include charging customers to use the loo. He said that charging customers £1 to use the facilities will encourage travellers on one hour flights to use airport bathrooms instead of airplane bathrooms.

In addition to the coin-operated bathrooms, O'Leary added: "The other change we've been looking at is taking out the last 10 rows of seats so we will have 15 rows of seats and the equivalent of 10 rows of standing area."
This "standing" area with "vertical seats" will be introduced at the back of its fleet of 250 planes, and a Ryanair spokesman has said that Boeing has already been consulted over refitting the fleet with "vertical seats" which would allow passengers to be strapped in while standing up, which would cost between £4 and £8 per person.
However, a spokesman for the Civil Aviation Authority--the English FAA--has said the plans would struggle to meet safety requirements: "It's aviation law that people have to have a seat-belt on from take-off and landing so they would have to be in a seat. I don't know how Mr O'Leary would get around that one. During turbulence passengers also have to have a seat-belt on."

I think I'll pass on the standing up and flying.

Andrew Cuomo Vows To Fight For Marriage Equality

Well, this is encouraging news....for New York.

New York Attorney General, Andrew Cuomo, has announced that if he's elected governor this fall, he would push to legalize gay marriage in New York during his first year in office. When asked about marriage equality, he said, plainly: “It’s a priority.”

I didn't here any if's, and's or but's in there.

And though he does admit that state lawmakers have plenty on their plates right now, especially with budgetary issues, Cuomo does think a marriage equality bill could pass the Legislature in 2011, an off-election year.

It was just last December when the New York State Senate rejected a gay marriage bill in a lopsided 38-24 vote, a defeat for advocates who had waged a long, expensive campaign and had won pledges of support from Senate Democratic leaders. Naturally, not a single Republican voted for the bill, but what hurt was that eight Democrats opposed it.

So, Andrew Cuomo's affirmation of working towards marriage equality is a good thing, even if he has always been on our side. See, he hasn't always been for lack of a better word, a fierce advocate for LGBT rights. When he ran for governor back in 2002, he opposed marriage equality, while saying he favored civil unions. It wasn't until 2006, when he was running for Attorney General, that he declared his support for marriage equality.

And now he's saying it again, plainly. It is a priority.
